THE PROFESSION OF NOTARY

More than a century ago, the new Civil Code settled the question of notaries in a lapidary way: “The cantons determine the terms of the authentic form for their territory”. This qualified form is still at the heart of the most important institutions of private law. Notarial law has constantly evolved through the contributions of doctrine and jurisprudence. The book provides an overview of the situation by describing the obligations imposed on all notaries, beyond the specificities of each canton. It outlines recent developments related to competition law, European law, new computer technologies and evolutions in tax law. It also includes a summary of the cantonal laws of French-speaking Switzerland describing for each canton the provisions applicable to liability, remuneration and access to the profession.
